REGULATION
of the Secretariat of the Commission on Combating Corruption of the Republic of Azerbaijan
I. General Provisions
1. The Secretariat of the Commission on Combating Corruption of the Republic of Azerbaijan (hereinafter referred to as the “Commission’) is established in accordance with Article 15 of the “Regulation on the Commission on Combating Corruption of the Republic of Azerbaijan”, approved by Law No. 906-IIQ of the Republic of Azerbaijan dated May 3, 2005.
2. The Secretariat of the Commission (hereinafter referred to as the “Secretariat”) is the permanent operational body of the Commission.
3. The Secretariat conducts its activities based on the Constitution of the Republic of Azerbaijan, international treaties to which Azerbaijan is a party, laws and other normative legal acts of the Republic of Azerbaijan, the Commission's Regulation, and its decisions.
4. The Secretariat operates in close coordination with the Chairperson and members of the Commission and provides regular updates on its activities.
II. Rights and Responsibilities of the Secretariat
5. The main responsibilities of the Secretariat are as follows:
5.1. To address organizational matters related to holding Commission meetings.
5.2. To prepare documents for issues to be discussed by the Commission and to handle clerical and other organizational tasks.
5.3. To draft the agenda for Commission meetings.
5.4. To inform Commission members of the agenda, date, and venue of meetings.
5.5. To prepare proposals on issues within the Commission's competence for its consideration.
5.6. To receive and review suggestions and opinions from Commission members on combating corruption, conduct analyses, and present findings to the Commission.
5.7. To collect, analyze, and summarize opinions from Commission members on discussed topics.
5.8. To analyze and consolidate information from relevant entities regarding state programs addressing issues within the Commission's competence.
5.9. To compile information from Commission members for the preparation of the Commission's annual report and draft the report.
5.10. To organize the receipt of financial data.
5.11. To register, collect, analyze, and summarize complaints and other information related to corruption.
5.12. To organize invitations for representatives of state bodies and non-governmental organizations to Commission meetings.
5.13. To organize the activities of working groups established within the Commission, determine their composition, and coordinate their activities.
5.14. To draft necessary documents for issues to be discussed by the Commission and present them to Commission members.
5.15. To record the minutes of Commission meetings, prepare drafts of final documents and decisions, and submit them to the Chairperson of the Commission.
5.16. To organize public awareness efforts about the Commission's activities and its decisions.
5.17. To perform other tasks assigned by the Commission within its competence.
6. For the fulfillment of its responsibilities, the Secretariat has the following rights:
6.1. To request necessary information and materials on issues within the Commission's competence from state and local self-government bodies on behalf of the Commission.
6.2. To analyze the status of anti-corruption efforts.
6.3. To study issues for enhancing the effectiveness of anti-corruption measures and eliminating identified deficiencies.
6.4. To assess public opinion on corruption-related matters and organize public awareness activities as determined by the Commission.
6.5. To collaborate with non-governmental organizations, mass media representatives, private sector entities, and independent experts, and involve them in specific tasks as necessary.
6.6. To participate in international cooperation aimed at organizing and enhancing the effectiveness of anti-corruption efforts.
6.7. To study anti-corruption legislation and propose recommendations for its improvement to the Commission.
7. To exercise other rights delegated by the Commission.
III. Organization of the Secretariat's Activities
8. The Secretariat consists of a Secretary and three staff members.
9. The Secretary of the Secretariat is appointed and dismissed by the decision of the Commission, while other staff members are appointed and dismissed by the Chairperson of the Commission.
10. The Secretary of the Secretariat:
10.1. Organizes and leads the Secretariat's activities and bears personal responsibility for the fulfillment of its duties.
10.2. Reports to the Commission on the Secretariat's activities.
10.3. Executes the instructions of the Commission's Chairperson related to the organization of the Commission's work.
10.4. Allocates responsibilities among the Secretariat's staff.
10.5. Represents the Commission, with the Commission's consent, and speaks on its behalf.
10.6. Engages with Commission members regarding the organization and implementation of the Commission's activities.
10.7. Ensures organizational measures for handling complaints and applications related to corruption.
10.8. Supervises and coordinates the activities of working groups within the Commission.
10.9. Ensures the collaboration between the staff and working groups.
10.10. Monitors compliance with laws, service discipline, and confidentiality among staff.
10.11. Proposes staff appointments to the Commission.
10.12. Requests the Chairperson's approval for staff incentives or disciplinary actions.
10.13. Requests the Chairperson's approval for staff leave or business trips.
10.14. Organizes citizen reception activities.
10.15. Carries out other powers delegated by the Commission.
11. In the absence of the Secretary, their duties are temporarily performed by one of the Secretariat's staff members appointed by the Chairperson of the Commission.
